Overview
A large number of other regulations relating to the practice of the legal profession are spread across other laws, such as the Legal Services Act, the Money Laundering Act, the Civil Procedure Act or the Criminal Code:
In the case of cross-border activities within Europe (EU, EFTA, EEA, as well as Ukraine and Turkey), the lawyer must also observe the regulations of the Association of European Bars and Law Societies (CCBE) / Règles professionnelles du Conseil des barreaux européen.
Lawyers who have been admitted to practice in another EU member state and (also) practice in Germany are also subject to the so-called Law on the Activities of European Lawyers in Germany (EuRAG) or the Regulation on the Implementation of Section 206 BRAO for lawyers from non-European countries.
The professional law of lawyers is mainly regulated in the Federal Lawyers' Act (BRAO). It contains, among other things, the basic regulations on admission to the legal profession and on the rights and obligations in the context of practicing the legal profession. The Professional Code of Conduct for Lawyers (BORA) and the Specialist Lawyers' Code (FAO) supplement the BRAO.
As for many other professions, the importance of the following legal acts of Union law must also be emphasized:
- Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) and
- Directive 2006/123/EC of the European Parliament and of the Council of December 12, 2006 on services in the internal market
